Divorce from a foreigner in Slovakia
Question
I am a Slovak citizen currently living in Slovakia, while my husband, who is British, resides in England. Our marriage was entered into in 2017 abroad, outside the EU, where it was registered for the first time. Since then, we have registered as a married couple in both the United Kingdom and Slovakia.
We are currently separated, and our marriage cannot be saved. I need to arrange the divorce in the simplest way possible, ideally by having my soon-to-be ex-husband just sign the necessary documents, as I do not expect much cooperation from him. The situation is tense and complicated, so I am looking for the simplest and most peaceful solution.
I would greatly appreciate any advice or explanation on how these matters are handled. Thank you, and I wish you a pleasant day.

Thank you for your message, we would be happy to assist you with the divorce proceedings.
If we understood correctly, the marriage was recognized in Slovakia. Unfortunately, according to Slovak law, it is not possible to simply “sign the divorce documents” if the marriage was recognized in Slovakia. A court must decide on the divorce. If your husband agrees to the divorce, we have encountered situations where a consent statement from the other spouse was submitted to the court, and in some cases, the spouse’s attendance was not required (however, we cannot guarantee this).
The situation would be simpler if there are no minor children from the marriage (which you did not mention).
We therefore recommend scheduling a video or in-person consultation to go over your case, address your questions, and propose the next steps.
