Temporary Employment Agency License (AÜ-Erlaubnis) in Germany

What is needed to obtain an AÜ-Erlaubnis?
For a Slovak temporary employment agency (ADZ) to obtain a permit for agency employment in Germany (Arbeitnehmerüberlassungserlaubnis / AÜ-Erlaubnis), the following documents will be required:
- Founding document/articles of association
- Extract from the company’s commercial register
- Criminal records certificates
- Police clearance from Germany
- Proof of accident insurance
- Confirmations from health insurance companies that there are no outstanding insurance debts
- Bank statements from all business accounts (the account must have at least €10,000 available; if the agency has at least 5 employees being posted abroad, there must be at least €2,000 per employee)
- Employee loan agreement (between the Slovak ADZ and employees) and the assignment contract with the user company to which the employees are provided (Arbeitsvertrag, Arbeitnehmerüberlassungsvertrag – prepared by a collaborating lawyer in Germany).
